Response to Court of Appeals Ruling Against Student Privacy: "We will continue advocating for these young students."

 

In a very rare move by any court, a three judge panel of the U.S. Court of Appeals for the 3rd Circuit ruled against student privacy nearly immediately after the agruments were made in the case Doe v. Boyertown Area School District.

 

The legal team spoke afterwards:

 

"No student should be forced into an intimate setting—like a locker room or shower—with someone of the opposite sex. The Boyertown District could have crafted policies that respect the privacy concerns of all students and are also sensitive to the needs of individual students. Instead, the district failed to fulfill its responsibility and harmed students rightfully concerned about their bodily privacy." - Randall Wenger, Chief Counsel - Independence Law Center

 

"A girl's privacy rights do not depend on what a boy believes about gender. Her bodily privacy from the opposite sex is hers, and does not exist or disappear based on anything a man believes." - Jeremy Samek, Senior Counsel - Independence Law Center

 

"The Supreme Court has already spoken: The real differences between men and women mean that privacy must be protected where it really counts, and that certainly includes high school locker rooms and restrooms. This decision is out of step with longstanding legal protection for privacy. Alexis LightcapOne of the six courageous students directly involved in the lawsuit chose for the first time to publicly reveal her identity and to share more of her story. She was present outside the courtroom after the ruling was made: "Today's ruling was very disappointing, and made me feel—again—like my voice was not heard. Every student's privacy should be protected."

 

 

Next step

The court still has to file a written ruling and no action can be taken until this ruling has been filed. One report says the formal written decision will be made on June 4th. Please continue to pray for this case, the students involved and for the entire legal team.
