Sponsoring of SCOTUS brief regarding parental rights The Independence Law Center recently sponsored an amicus brief in the case of Frank G. v Joseph P. that petitions the Court to uphold a parent's right to custody of their child. There is a longstanding precedent in favor of the importance of parental rights, yet it is now being questioned. The right of a parent to not lose custody of their child to a former same-sex partner who is neither an adoptive or biological parent should be honored. New Yorkers for Constitutional Freedoms (NYCF) and The National Association of Parents Inc. (ParentsUSA) seek to show the Court via this brief that the parental presumption of full custody and rights to care are consistent with the Due Process clause of the Fourteenth Amendment.
